Abstract: The pursuit of Public Financial Management Reforms (PFMR) is centered on, among other functions, enhancing transparency in governance, increasing prudential allocation of financial capital, accountability in financial management, separating policy and management functions. The PFMRs seek to address gaps identified in the devolved systems of government and public organizations to remedy inadequate strategy orientation and lapsed strategy as well as to build on institutional transformation. In Kenya, the PFMRs seek to ensure fiscal efficiency and discipline in the use of public finances by enhancing public service efficiency and safeguarding available resources to be used in the best interest of the people. This study sought to examine the influence public financial management reforms on budget implementation by Kenyan city counties. The PFMRs studies included IFMIS Re-Engineering and fiscal decentralization. The study was based on modern portfolio theory, resource-based theory and stakeholder theory and relied on an expost-facto descriptive research design with a survey method to determine the relationships between the study variables. Structured questionnaires, data collection sheets and interview schedules were used to collect data which was then cleaned, coded and scrutinized thoroughly for completeness. The study relied on primary data collected from the treasuries, directorates of economic planning, budget offices, IFMIS departments and sectoral departments of Nairobi city county, Mombasa city county and Kisumu city county respectively. Secondary data was obtained from the annual county governmets’ budget implementation reports. The data was analyzed using SPSS version 24. Statistical measures such as means, percentages and standard deviation were used to interpret the data. The researcher also performed both a linear regression analysis and a Spearman correlation analysis to show the relationships between the study variables. The study revealed strong positive and statistically significant correlation between fiscal decentralization and budget implementation while IFMIS re-engineering had a negative and statistically insignificant correlation with budget execution. The results of the study were considered pivotal to the national government, the legislature, national treasury, county governments and respective sectoral departments, the Commission for Revenue Allocation, the office of the controller of budget, the public, budget implementation oversight agencies and county chiefs as it highlights important correlates of effective budget execution.

Abstract: Ukraine's aspiration for European Union integration has been defined in national policies, laws and international treaties since 1994: within the Partnership and Cooperation Agreement framework between Ukraine and the European Union (1994), the Eastern Partnership (2009), the Law of Ukraine "On the Principles of Internal and Foreign Policy" and many others. However, all these documents were of a predominantly advisory nature, without establishing a strategic need for approximation of Ukrainian legislation to EU norms, especially in the field of environmental protection and climate change mitigation. The Association Agreement between Ukraine and the European Union, signed in 2014, aims to gradually bring Ukrainian legislation in line with objectives enshrined in the EU law, which envisages "transposition" of EU law norms into the Ukrainian legal system. This paper provides detailed assessment of main stages and achievements of Ukraine’s approximation process to the European environmental law (both in terms of Eastern European specifics of environmental regulation and national challenges), and puts emphasis on institutional challenges, environmental and climate governance, proficient translation of European legislation and key requirements for public administration, related to environmental laws’ approximation.

Abstract: The study is aimed to determine effective factors in respecting to clients by municipality's metropolitan authorities and grouping them into two groups of staff and city management organization to form the first step of the process on this basis. The research methodology based on conceptual model and on the thematic literature and the research carried out through 34 factors initially in two sections of staff and organization group by registration of the main variables and related data in the software, 306 regulatory questionnaires in Likert spectrum the correct data was initiated and ready to conformity factor analysis. The first output is the index value of the Bartlett test statistic equal to 0.882 (close to number 1) which shows the number of samples (in this example number of respondents) is sufficient for factor analysis. Also, sig value of Bartlett's test is less than 5%, which indicates that the factor analysis is appropriate for identifying the structure, factorial model. The number of variables is reduced from 34 to 30 based on final subscription value (less than 0.5). As a result, the final variables affecting respect on client by metropolitan municipality according to the proposed model are divided into 17 variables in the organization main factor group and 13 variables in employees factor group.

Abstract: The study aims to investigate the relationship between quality of management, innovation and long term orientation towards company performance in high performing organisations in Malaysia. Using convenience based sampling methods authors have used quantitative methodology, where total set of n=120 questionnaires have been distributed amongst top 30 high performing organisations listed in Bursa Malaysia. Authors have used statistical package for social sciences (SPSS) to conduct data analysis using descriptive and inferential statistics. Descriptive statistics has been used to conduct demographic analysis of respondents catered by researcher to ensure adequate sampling techniques, whereas inferential statistical analysis has been conducted to make analysis for the variables included in the study. Authors have used Pearson correlation and multiple regression analysis to interpret the results. The research findings reveal that only innovation and long term orientation has significant relationship towards company performance in high performing organisation in Malaysia, whereas quality of management is not significant towards company performance in high performing organisations.

Abstract: Decision making is one of the most important elements in the functioning of an organisation. Every day we face numerous alternatives and have to make a decision about which one to select. A well-crafted decision can help the organisation move in the right direction and affect people across the organisation to a large extent, thus to be effective, one needs to be aware of their decision making styles so that an attempt can be made to evolve and work on inefficient and ineffective styles to make themselves better equipped to make the decisions that are required. From an organisational point of view, since the success or failure can be vastly impacted by decisions made by the employees it is important that they find out the decision making style and then use it for further developmental purposes or even for finding the right person-job fit. Since a university is an organisation and professors form a core group whose decisions impact not only the success of the institution but also the future of our country as a consequence of the bearing their decisions have on the students who are the future leaders of this nation. In the Indian context, with the youth constituting a major part of the population, the impact of professors is extremely high. Research suggests that while people may have different decision making styles but they have a high predisposition towards one particular style and that is explored in this study. The study delved into the impact of personality types on decision making styles and it revealed that there is a direct and positive relationship between conscientiousness and a rational decision making style, between neuroticism and an avoidant decision making style, openness to experience and an intuitive decision making style. A demographic factor, age and its impact on intuitive decision making style was tested which indicated that no such relationship exists. Finally, the impact of self-esteem on an individual’s decision making style suggests that people with high self-esteem have a predisposition towards a rational decision making style and they are unlikely to have an avoidant decision making style.

Abstract: Arbitration agreement is the bedrock of every arbitral proceedings and it is the corner stone of the jurisdiction vested on the arbitrators to arbitrate on any matter referred to them. The agreement could take various forms and character (oral or written) depending on the governing law. It is not all issues and subject matters that are arbitrable. Different national legislation and public policy have limited the scope of arbitration with respect to the issue of arbitrability. Not all matters are capable of being referred to arbitration. Certain matters are reserved for the court alone and if an arbitral tribunal purports to deal with them the resulting award will be unenforceable. We have arbitrability based on agreement and arbitrability based on law and public policy. In this work, efforts shall be made to address all issues with respect to arbitration agreement under the Act and the concept of arbitrability.
